Regulation 119 issued from the Department of Financial Services stipulates that companies who develop, implement, and maintain safe patient handling programs may receive up to a 2.5% NY workers compensation safe patient handling credit .
During the 2014 NY State Budget there were rules that requires health care facilities to establish safe patient handling programs by Jan 1st 2017. The budget required the NY State Department of Financial Services to issue regulations allowing facilities that implement these programs to lower their NY Workers Compensation insurance premiums.
This NY Safe Patient Handling Credit is available to :
- General Hospitals
- Residential Health Care Facilities
- Diagnostic and treatment centers
- Clinics
- Health care service facilities operating on State University of New York campuses, operated by the state Office of Children and Family Services, and operating in state prisons
- In-patient services of psychiatric centers and residential facilities for individuals with developmental disabilities
The NY State Safe Patient Handling Program must include :
- Implementation of a formal written safe patient handling policy.
- Various Patient handling hazards assessments written and recorded.
- Protocols for identifying use case studies related to the formal safe patient .
- Specific initial and follow up training for incident investigations.
- Annual performance evaluations of the NY Safe Patient Handling Program.
- Evaluations for proper engineering and design as it relates to the NY Safe Patient Handling rules for new construction AND renovations relating to the facilities.
Insurance carriers must verify that a facility has implemented and meet the requirements of the NY Safe Patient Handling Program before the credit can be applied. The New York Compensation Rating Board or the National Council of Compensation Insurance for multi state risks with NY locations must file the amount of the credit; how it shall be applied; and when.

The NY Workers Compensation Rating Board and the National Council of Compensation Insurance must report annually to the NY State Department of Financial Services about policies receiving the credit.
